Emergency departments are challenging research settings, where truly informed consent can be difficult to obtain. A deeper understanding of emergency medical patients’ opinions about research is needed. We conducted a systematic review and meta-summary of quantitative and qualitative studies on which values, attitudes, or beliefs of emergent medical research participants influence research participation. We included studies of adults that investigated opinions toward emergency medicine research participation. We excluded studies focused on the association between demographics or consent document features and participation (...) and those focused on non-emergency research. In August 2011, we searched the following databases: MEDLINE, EMBASE, Google Scholar, Scirus, PsycINFO, AgeLine and Global Health. Titles, abstracts and then full manuscripts were independently evaluated by two reviewers. Disagreements were resolved by consensus and adjudicated by a third author. Studies were evaluated for bias using standardised scores. We report themes associated with participation or refusal. Our initial search produced over 1800 articles. A total of 44 articles were extracted for full-manuscript analysis, and 14 were retained based on our eligibility criteria. Among factors favouring participation, altruism and personal health benefit had the highest frequency. Mistrust of researchers, feeling like a ‘guinea pig’ and risk were leading factors favouring refusal. Many studies noted limitations of informed consent processes in emergent conditions. We conclude that highlighting the benefits to the participant and society, mitigating risk and increasing public trust may increase research participation in emergency medical research. New methods for conducting informed consent in such studies are needed. (shrink)

The essays in this book, by a variety of leading Augustine scholars, examine not only Augustine's multifaceted philosophy and its relation to his epoch-making theology, but also his practice as a philosopher, as well as his relation to other philosophers both before and after him. Thus the collection shows that Augustine's philosophy remains an influence and a provocation in a wide variety of settings today.

Martin Luther King, Jr.’s “Letter from a Birmingham Jail” has been canonized as an essential statement of the political theory of civil disobedience. This article examines the early reception of King’s essay and the development of the liberal idea of civil disobedience it has become synonymous with to argue that its canonization coincided with, and displaced, the radicalization of King’s developing thinking about disobedience. It examines published and archival writings from 1965 through 1968 to reconstruct King’s power-oriented theory of “mass” (...) civil disobedience as it developed in response to the dual challenges of white backlash and Black Power. The basic challenge of mass civil disobedience is how to mobilize liberating acts of taking power without undercutting the possibility of transformative integration through sharing power. To articulate this dilemma, this article draws on an undertheorized category from John Rawls’s A Theory of Justice to conceptualize disobedience as a practice of militant love. (shrink)

Love is a key concept in the theory and history of civil disobedience yet it has been purposefully neglected in recent debates in political theory. Through an examination of Martin Luther King, Jr.’s paradoxical notion of “aggressive love,” I offer a critical interpretation of love as a key concept in a vernacular black political theology, and the consequences of love’s displacement by law in liberal theories of civil disobedience. The first section locates the origins of aggressive love in an earlier (...) generation of black theologians who looked to India’s anticolonial struggle to reimagine the dignity of the oppressed as “creative survival.” The second contextualizes King’s early sermons on moral injury and self-respect within this tradition to reinterpret Stride toward Freedom’s account of the dignity-enhancing effects of nonviolent resistance as the triumph of love over fear. The third considers the implications of these arguments for conceptualizing the moral psychology of the white citizen and its consequences for contemporary debates over the ideological uses of Civil Rights history. The call to respond to oppression with aggressive love illustrates the paradoxical character of civil disobedience obscured by legal accounts as well as by criticisms of the very idea of “civil” disobedience. This is the paradox of affirming civility while enacting disobedience in order to bind political confrontation with political pedagogy. (shrink)

ISBN 0-262-11258-2 Sybil Kantor's history of the intellectual origins of (...) the Museum of Modern Art (MoMA) is an engaging account of Alfred Barr, Jr.'s, pivotal role in acquainting an American audience with the modernist movement in art that had developed in Europe and the Soviet Union in the first part of the twentieth century. Scrupulously documented, Kantor's narrative relies heavily on interviews with Barr's contemporaries, his publications, and his extensive correspondence. She also limns portraits of major figures who either influenced his ideas or were instrumental in establishing MoMA. Although the book is very informative about modern art, according to its author it is not intended to be strictly a history of that art. Rather, it is devoted to Barr's early development, his personal characteristics, his attitude toward the cultural and political climate of the times, his definitions of modernism and formalism, and finally, his legacy.Kantor traces Barr's career through the decade of the 1920s, which culminated in his being named the first director of MoMA in 1929; the expansive years of the 1930s and 1940s when, as Kantor puts it, Barr and the museum were at full throttle; and the later years when Barr was relieved of his director's responsibilities to allow him to spend more time on writing and the mounting of exhibitions. He retired from the museum in 1967, began to show signs of ill health in the mid-1970s, and died at the age of 79 in 1981. The Early Years Barr began his studies in the history of art at Princeton where he took courses with Frank Jewett Mather, who taught about modern art, and with Charles Rufus Morey, a distinguished medievalist whose teaching ranged beyond the architecture and sculpture of the Middle Ages to the other arts of that era. Morey's example of comprehensiveness would later stimulate Barr to think along similar lines about modern art and the organization of MoMA. At Harvard's graduate school Barr learned the skills of connoisseurship and museum management from Paul Sachs whose students went on to become directors of major museums across America. This volume presents a commentary on Aristotle's Metaphysics Book 12 by pseudo-Alexander in a new translation accompanied by explanatory notes, introduction and indexes. Fred D. Miller, Jr. argues that the author of the commentary is in fact not Alexander of Aphrodisias, Aristotle's distant successor in early 3rd century CE Athens and his leading defender and interpreter, but Michael of Ephesus from Constantinople as late as the 12th century CE. Robert Browning had earlier made the case that Michael was (...) enlisted by Princess Anna Comnena in a project to restore and complete the ancient Greek commentaries on Aristotle, including those of Alexander; he did so by incorporating available ancient commentaries into commentaries of his own. Metaphysics Book 12 posits a god as the supreme cause of motion in the cosmic system Aristotle had elaborated elsewhere as having the Earth at the centre. The fixed stars are whirled around it on an outer sphere, the sun, moon and recognised planets on interior spheres, but with counteracting spheres to make the motions of each independent of the motions of others and of the fixed stars, thus yielding a total of 55 spheres. Motion is transmitted from a divine unmoved mover through divine moved movers which move the celestial spheres, and on to the perishable realms. Chapters 1 to 5 describe the principles and causes of the perishable substances nearer the centre of the universe, while Chapters 6 to 10 seek to prove the existence and attributes of the celestial substances beyond. Some philosophers and physicians have argued that alcoholic patients, who are responsible for their liver failure by virtue of alcoholism, ought to be given lower priority for a transplant when donated livers are being allocated to patients in need of a liver transplant. The primary argument for this proposal, known as the Responsibility Argument, is based on the more general idea that patients who require scarce medical resources should be given lower priority for those resources when they are responsible for (...) needing them and when they are competing with patients who need the same resources through no fault of their own. Since alcoholic patients are responsible for needing a new liver and are in direct competition with other patients who need a new liver through no fault of their own, it follows that alcoholic patients ought to be given lower priority for a transplant. In this article, I argue against the Responsibility Argument by suggesting that in order for it to avoid the force of plausible counter examples, it must be revised to say that patients who are responsible for needing a scarce medical resource due to engaging in behavior that is not socially valuable ought to be given lower priority. I'll then argue that allocating organs according to social value is inconsistent or in tension with liberal neutrality on the good life. Thus, if one is committed to liberal neutrality, one ought to reject the Responsibility Argument. (shrink)

We consider games over a finite alphabet with Gurevich-Harrington's winning conditions and restraints as in Yakhnis-Yakhnis . The game tree, the Gurevich-Harrington's kernels of the winning condition and the restraints are defined by finite automata. We give an effective criterion to determine the winning player and an effective presentation of a class of finite automata defined winning strategies.Our approach yields an alternative solution to the games considered by Büchi and Landweber . The BL algorithm is an important tool for solving (...) effectively presented games. The differences between the BL and our algorithms are as follows. Our algorithm is uniformly applicable to winning sets that correspond to boolean combinations of BL winning conditions, while the BL algorithm requires a transformation of such boolean combinations into a single BL condition. Our algorithm directly applies to a larger class of game trees for a given game alphabet than does the BL one. We describe Büchi-Landweber's class of winning conditions in a more transparent way by using finite automata and Gurevich-Harrington's form of winning conditions. Our algorithms that determine the winner of the game and find a winning strategy, are based on a translation of the events in the game in terms of the transition table of the automaton representing the game. This automaton differs from the ones that represent BL winning conditions. Both algorithms need further investigation.The algorithm determining the winner in the game, can be used as a verifier of concurrent programs. This is because programs can be viewed as strategies in Gurevich-Harrington's games and program specifications could be regarded as winning conditions for such games. The algorithm which finds a winning strategy could be used as a basis for automated concurrent program design.The present paper is a sequel to Annals of Pure and Applied Logic 48 277–297. (shrink)

Dieser Artikel untersucht den zweideutigen Status der Rhetorik, der zwischen echter Philosophie und bloßer Sophisterei angesiedelt ist, anhand von Alan Badious drei exemplarischen Denkfiguren: dem Philosophen, dem Anti-Philosophen und dem Sophisten. Mit der jüngsten Rückkehr des Sophisten in die Politik in Form populistischer Politiker hat die zeitgenössische Rhetorikforschung die Notwendigkeit zum Ausdruck gebracht, dass die Disziplin ihr Bündnis mit der relativistischen Sophistik überdenkt. Indem Badious drei exemplarische Figuren untersucht und sie mit seinem Verständnis der drei Formen der Negation in Beziehung (...) gesetzt werden, untersucht der Artikel eine mögliche Kluft zwischen sophistischer Rhetorik und antiphilosophischem Populismus, die das vorherrschende Verständnis der Beziehung zwischen Rhetorik, Philosophie und Sophistik verkompliziert. Schließlich wirft der Artikel einige Fragen dazu auf, wie die Exemplarität im Allgemeinen und die drei exemplarischen Figuren im Besonderen in den Rahmen von Badious gesamter Philosophie eingeordnet werden können, und erörtert, wie man diesen Einschränkungen möglicherweise entgegenwirken kann. The scaling of body parts is central to the evolution of morphology and shape. Most traits scale proportionally with each other and body size such that larger adults are essentially magnified versions of smaller ones. This pattern is so ubiquitous that departures from it – disproportionate scaling between trait and body size – pique interest because it can generate dramatically exaggerated traits. These extreme morphologies are frequently hypothesized to result from sexual selection and their study has a long history, with (...) several hypotheses seeking to explain their evolution. Despite this effort, surprisingly little progress has been made in demonstrating the forms of selection that produce different scaling patterns or in identifying the mechanisms that underlie the expression and evolution of scaling relationships. Here we review recent insights regarding the proximate mechanisms that regulate and integrate trait growth and that offer a new framework for studying the evolution of morphological scaling. Alexander X. Douglas situates Spinoza's philosophy in its immediate historical context, and argues that much of his work was conceived with the aim of rebutting the claims of his contemporaries. In contrast to them, Spinoza argued that philosophy reveals the true nature of God, and reinterpreted the concept of God in profound and radical ways.

Originally the constitution was expected to express and channel popular sovereignty. It was the work of freedom, springing from and facilitating collective self-determination. After the Second World War this perspective changed: the modern constitution owes its authority not only to collective authorship, it also must commit itself credibly to human rights. Thus people recede into the background, and the national constitution becomes embedded into one or other system of 'peer review' among nations.This is what Alexander Somek argues is the (...) creation of the cosmopolitan constitution. Reconstructing what he considers to be the three stages in the development of constitutionalism, he argues that the cosmopolitan constitution is not a blueprint for the constitution beyond the nation state, let alone a constitution of the international community; rather, it stands for constitutional law reaching out beyond its national bounds. This cosmopolitan constitution has two faces: the first, political, face reflects the changed circumstances of constitutional authority. It conceives itself as constrained by international human rights protection, firmly committed to combating discrimination on the grounds of nationality, and to embracing strategies for managing its interaction with other sites of authority, such as the United Nations. The second, administrative, face of the cosmopolitan constitution reveals the demise of political authority, which has been traditionally vested in representative bodies. Political processes yield to various, and often informal, strategies of policy co-ordination so long as there are no reasons to fear that the elementary civil rights might be severely interfered with. What is honor? Has its meaning changed since ancient times? Is it an outmoded notion? Does it still have the power to direct our behavior? In this provocative book Alexander Welsh considers the history and meaning of honor and dismisses the idea that we live in a post-honor culture. He notes that we have words other than _honor_, such as _respect_, _self-respect_, and personal _identity_, that show we do indeed care deeply about honor. Honor, he argues, is a continuing (...) process of respect that motivates or constrains members of a peer group. Honor’s dictates function as moral imperatives. Surprisingly, little systematic study of the history of honor in Western culture has been attempted. Offering a welcome remedy, Welsh provides a genealogy of approaches to the subject, mining some of the most influential texts of the Western tradition. He rereads with fascinating results the works of Aristotle, Cicero, Shakespeare, Mandeville, Montesquieu, Rousseau, Kant, Adam Smith, and others. Among all organisms, the size of each body part or organ scales with overall body size, a phenomenon called allometry. The study of shape and form has attracted enormous interest from biologists, but the genetic, developmental and physiological mechanisms that control allometry and the proportional growth of parts have remained elusive. Recent progress in our understanding of body‐size regulation provides a new synthetic framework for thinking about the mechanisms and the evolution of allometric scaling. In particular, insulin/IGF signaling, which plays (...) major roles in longevity, diabetes and the regulation of cell, organ and body size, might also be centrally involved in regulating organismal shape. Here we review recent advances in the fields of growth regulation and endocrinology and use them to construct a developmental model of static allometry expression in insects. This model serves as the foundation for a research program that will result in a deeper understanding of the relationship between growth and form, a question that has fascinated biologists for centuries. We extend Gurevich-Harrington's Restricted Memory Determinacy Theorem), which served in their paper as a tool to give their celebrated “short proof” of Robin's decision method for S2S. We generalize the determinacy problem by attaching to the game two opposing strategies called restraints, and by asking “which player has a strategy which is a refinement of the restraint for the player and such that it wins the game against the restraint of the opponent?” We give a solution for the Determinacy with (...) Restraints Problem in the class of strategies with restricted memory for the GH games. The solution includes a criterion for the winning player and an explicit class of winning strategies. A determinacy result which includes similar information was first discovered by Büchi and Landweber and extended by Büchi . However, these pioneering works do not consider the determinacy with restraints. Also, the explicit presentation of winning strategies in these insightful papers does not emphasize their modular construction as do GH's and our proofs. In our view, this is a source of a difficulty in understanding these papers. Games with restraints and modular construction of winning strategies have applications to the semantics, development and verification of concurrent programs. A concurrent program can be viewed as a strategy in a certain game and a program specification can be regarded as a combination of a winning condition and restraints for the game , A. Yakhnis and V. Yakhnis ). The modularity of a winning strategyfor the game helps to generate a concurrent program from the strategy that satisfies the specification ). It turns out that such program specification requirements as mutual exclusion and an absence of a lockout or a deadlock are naturally represented as Büchi's or Gurevich-Harrington's winning conditions. In a homogeneous jury, the votes are exchangeable correlated Bernoulli random variables. We derive the bounds on a homogeneous jury’s competence as the minimum and maximum probability of the jury being correct, which arise due to unknown correlations among the votes. The lower bound delineates the downside risk associated with entrusting decisions to the jury. In large and not-too-competent juries the lower bound may fall below the success probability of a fair coin flip—one half, while the upper bound may not (...) reach a certainty. We also derive the bounds on the voting power of an individual juror as the minimum and maximum probability of her/his casting a decisive vote. The maximum is less than one, while the minimum of zero can be attained for infinitely many combinations of distribution moments. (shrink)

In the paper, a detailed analysis of some new logical aspects of Cantor’s diagonal proof of the uncountability of continuum is presented. For the first time, strict formal, axiomatic, and algorithmic definitions of the notions of potential and actual infinities are presented. It is shown that the actualization of infinite sets and sequences used in Cantor’s proof is a necessary, but hidden, condition of the proof. The explication of the necessary condition and its factual usage within the framework of Cantor’s (...) proof makes, Cantor’s proof invalid. It’s shown that traditional Cantor’s proof has a second necessary, but hidden as well, condition which is teleological by its nature, i.e., is not mathematical. The explication of the second necessary condition makes Cantor’s statement on the uncountability of continuum unprovable from the point of view of classical logic.One of the most dramatic facts in history of science is connected just with the notion of actual infinity and consists in the following. On the one hand, Aristotle, Berkeley, Locke, Descartes, Spinoza, Gauss, Kant, Cauchy, Kronecker, Hermite, Poincaré, Bair, Borel, Brouwer, Quine, Wittgenstein, Weyl, Luzin, and a lot of other outstanding creators of classical logic and classical mathematics, during millenniums, stated categorically and insistently warned about that the actual infinity is a self-contradictory notion and its usage in mathematics is inadmissible (e.g., according to Poincare, “There is no actual infinity. - Cantorians forgot that and fell into contradictions. Later generations will regard Mengenlehre (set theory) as a disease from which one has recovered”). On the other hand, a lot of outstanding scientists of the XX c.c., such as Hilbert, Church, Turing, Gödel, etc., and modern axiomatic set theory as a whole ignored this (intuitive though) opinion of genii and accepted Cantor’s “transfinite paradise”, based on the actual infinity. In the paper some logical, philosophical, and psychological aspects of this historical “favorable opposition” are analyzed, and the fact that the scientific intuition of genii has won the historical battle against the mytho-’logic’ of Cantor’s transfinite ‘paradise’ is explained and logically justified.
